• This case was brought up, by .writ of error, from the Circuit Court of the United States for the Eastern District of Louisiana. The history of the case is this. In April, 1836, Charles S. Lee,- a resident of the county of Claiborne and State of Mississippi, was sued in the county court of Claiborne, by Christopher Dart and William Gardner, who called themselves late merchants and copartners trading under the style and firm of Dart & Co., and stated the suit to be for the use of Christopher Dart. It is not necessary to state the cause of action, or trace the progress of the suit minutely.…
