This matter is before the court on the plaintiff’s motion to amend his statement of claim in assumpsit. The application is opposed by the defendant, on the ground the amendment would introduce a new and independent cause of action barred by the statute of limitations.

The plaintiff filed a statement of claim based on an oral contract with the defendant on September 15, 1930.
