RYMER, Circuit Judge:

George Acri sued his former employer, Varían Associates, Inc., in California Superi- or Court, alleging age discrimination claims under both federal and California law, as well as contract claims under California law. The parties are non-diverse, but Varían removed the action to federal court on the basis of Acri’s claim under the Age Discrimination in Employment Act, 29 U.S.C. § 621 et seq. The district court granted summary judgment on the supplemental state law claims as well as the federal age discrimination claim.…
