The defendant in this case was prosecuted under section 114 of the Penal Code, for abandoning his child, and was convicted. The statute is as follows: "If- any father shall wilfully and voluntarily abandon his child, leaving it in a dependent and destitute condition, he shall be guilty of a misdemeanor.” The defendant complains that the verdict is contrary to law and to the evidence, and that the court erred in not charging the jury as to all of his contentions, the only ground of the motion for a new trial, besides the general grounds, assigning error as follows:» "Because the court erred in…
