TOM GRAY, Chief Justice.
Derrick Dwayne Grant pled guilty to the offense of burglary of a habitation with the intent to commit aggravated assault with a deadly weapon. Tex. Penal Code Ann. § 30.02 (Vernon Supp. 2010). He elected to have a jury determine his punishment, which was assessed at fifty-five years in prison. In his original brief on appeal, Grant raised two issues.
