Howard Jacobson appeals from an order of the United States District Court for the Southern District of New York (Cannella, Judge), dated July 25, 1984, denying his petition for a writ of habeas corpus. 591 F.Supp. 503. As the grounds for the habe-as application, petitioner alleges that he was denied a fair trial, in violation of his constitutional rights because of: (1) jury misconduct, (2) failure to produce a material witness, and (3) failure to permit a witness to testify. For the reasons stated herein, we affirm the decision of the district court.
