I. Introduction

We consider here plaintiffs Nelly Home Care, Inc. and Nelly LLC’s (hereafter collectively referred to as “Nelly”) .consolidated motion for summary judgment against the Government. Nelly brings this action seeking to recover a total of $4,000 in employment taxes it paid to the Internal Revenue -Service - (“IRS”) for tax years 2008 • through 2012, plus costs and- attorney’s fees. The Government determined that during these years Nelly had incorrectly classified its non-medical homecare service providers as independent contractors instead of employees.…
