N. W. Mann, on January 14, 1929, executed a will devising to his wife, Mollie L. Mann, certain property, including 17 3/4 acres known as the Bailey tract; by deed dated March 8,1929, in consideration of love and affection, he conveyed to her thirty acres known as the Mary E. Bailey tract. T. G. Mann, a younger brother, claims that under an agreement made with N. W. Mann he is the equitable owner of both of these tracts;.that N. W.
