NATURE OF CASE
Michael Gibson commenced this action for workers’ compensation benefits, including vocational rehabilitation. A single judge of the Workers’ Compensation Court awarded vocational rehabilitation but found that it was not appropriate to determine Gibson’s loss of earning power until he completed the vocational rehabilitation. A review panel found that the trial judge was clearly wrong in not assessing Gibson’s loss of earning power, as he had reached maximum medical improvement and had received an impairment rating with restrictions at the time of trial.
