Affirming.

Appellee was employed by a shipper in loading railroad cross-ties at Soldier Station on cars of apjoellant’s railroad. A flat car had been set in on the side track to be loaded with the ties. A local freight train in shifting cars in the siding had moved the one on which appellee was to work. The cars were started back to their proper position, and as they came to a stop, or.as they were coming to a stop at the place, appellee mounted the car to begin his work.
