This appeal involves a determination of the rights of parties under a percentage lease.

Appellees, Seymour Schweiger and Jimmie Komatsu, as co-trustees of the Komatsu-Okomato Trust (hereinafter referred to as lessors) brought an action against appellant, China Doll Restaurant, Inc., (lessee) seeking, among other relief: (1) an order terminating a lease existing between the parties, (2) damages and reasonable attorneys fees, and (3) damages for breach of an alleged oral agreement to mutually cancel a lease.
