Plaintiffs sued to recover damages for the wrongful death of their son, George E. Peters. Judgment was rendered for the plaintiffs, and the defendant appeals.
The defendant was engaged in the business of bridge and road building in the state of Kansas, and had elected to come under the workmen’s compensation act. He owned a farm in Sumner county, on which was a hedge fence which he desired to have taken out. To do that he purchased a stump puller and arranged with the plaintiff H. F.
