This suit was originally insti-

tuted in the district court of Limestone county, Tes., by R. L. Reed, plaintiff in error, against H. N. Harris, J. O. Galloway, and Continental State Bank of Beckville, Tes., a corporation. Trial in the district court resulted in a judgment for Reed-against all the named defendants. The bank alone appealed to the Court of 'Civil Appeals for the - Tenth District at Waco.
