— Action by appellee against appellant on a policy of insurance on the life of appellee’s son who died while in the military services of the United States. The complaint is in one paragraph, with the usual averments in cases of this character, except that it contains an allegation that after the death of the insured, the possession of the policy was surrendered to appellant’s agent who, at the time stated that he w'anted the policy for the purpose of making proofs of death; that the policy was later returned to appellee, but that while out of appellee’s possession, and without appellee’s…
