MEMORANDUM OPINION AND ORDER

FITZWATER, District Judge.

The dispositive question presented by the motion for summary judgment of defendant City of Coppell, Texas (the “City”) is whether there is a genuine issue of fact that the City intentionally discriminated based on race, in violation of the Fab-Housing Act (“FHA”), 42 U.S.C. § 3601 et seq., when it made the land use and zoning decisions at issue. Concluding that there is, the court denies the motion.
