This lawsuit challenging the Texas Department of Housing and Community Affairs’ (“TDHCA’s”) allocation of Low Income Housing Tax Credits (“LIHTC”) in the Dallas metropolitan area requires the court to decide whether plaintiff has proved that TDHCA intentionally discriminated based on race, in violation of the Equal Protection Clause of the Fourteenth Amendment and 42 U.S.C. § 1982, or that TDHCA’s allocation decisions had a disparate racial impact, in violation of *314§§ 3604(a) and 3605(a) of the Fair Housing Act (“FHA”).
