This was an action by appellee, G. P. Olmstead, against the appellant Beaumont, Sour Lake & Western Railroad Company, to recover damages for personal injuries sustained by him while he was engaged in the service of appellant as conductor on a work train, by breaking in two of its bridge across San Jacinto river over which the train was running, so that he and the cars were precipitated below and he caused to sustain serious and permanent injuries; the gravamen of the complaint being that appellant had failed to use ordinary care for. his safety, in that the bridge…
