Error to a judgment of the Hustings Court of the city of Portsmouth in an action of trespass on the case. Judgment for the defendant. Plaintiff assigns error.

This action was bi’ought by the plaintiff in error to recover damages for an injury alleged to have been caused by the negligence of the defendant in error. Three trials of the case were had in the lower court. In the first the verdict of the jury was set aside without objection. On the second trial there was again a verdict for the plaintiff, which was set aside upon the ground that the verdict was contrary to the law and the evidence.
