OPINION

CAFFREY, District Judge.

This is a petition for a writ of habeas corpus brought by Edward F. Owens, presently an inmate of the Massachusetts Correctional Institution at Walpole, against Palmer C. Scafati, Superintendent of the Institution.

The petition recites that Owens was found guilty after a jury trial in Suffolk Superior Court and that concurrent sentences were imposed on March 12, 1965 for the crimes of armed robbery and assault with a dangerous weapon.
