Defendant, Roy Hughes, was convicted of violation of the State Adverse Interest Act of July 19, 1957, P. L. 1017, 71 PS §776.1. The matter is now before the court on a motion for a new trial and a motion in arrest of judgment.

Defendant, Roy S. Hughes, was in November 1958, employed as a superintendent of the Tioga County Maintenance Department, Pennsylvania Department of Highways. On November 13, defendant called upon one R. J. Clark at Smethport, who defendant had learned had a bulldozer for sale.
