In their three-count petition, Plaintiffs sought ejectment, injunction, and damages due to Defendants’ construction of a road over Plaintiffs’ property outside of a granted easement. The trial court denied Plaintiffs’ request for ejectment and an injunction and granted Plaintiffs “nominal damages in the amount of $1.00 (one dollar).” Plaintiffs appeal, presenting four points relied on, contending that the trial court erroneously declared and applied the law and that its determination of damages was against the weight of the evidence.
