This appeal arises from a habeas corpus proceeding in the District Court for the Middle District of Florida in which Petitioner Alphonso Cave, convicted of murder and sentenced to death, raised thirteen claims for relief. The district court held an evi-dentiary hearing on Petitioner’s claim of constitutionally ineffective assistance of trial counsel. The court granted relief on the claim of ineffective assistance of counsel during the sentencing hearing, but denied the claim relating to the guilt phase.
