On March 30, 2001, consumers and third-party payors (“TPPs”) who paid all or part of the purchase price of Coumadin® warfarin sodium1 filed a consolidated class action complaint alleging, individually and on behalf of all others similarly situated, that defendant DuPont Pharmaceuticals Company2 (“DuPont”) caused them to overpay for Coumadin as a result of defendant’s anticom-petitive behavior and dissemination of false and misleading information about Coumadin and its generic competitor.
