Kitz, Judge:

The' plaintiff Doyal Moore instituted a suit in chancery in' the circuit court of Clay county against Joshua K. Moore, for the purpose of'enforcing the specific execution of a contract for the sale of real estate alleged to have been made by the said Joshua K. Moore with the deceased father of the said Doyal Moore. The defendant Joshua K. Moore demurred to the bill and answered the same, and the court being of opinion that the widow of'plaintiff’s father was a necessary party to the suit sustained the demurrer and remanded the cause to rules for the purpose of bringing in such…
