Robinson v. 211-11 Northern, LLC

In an action to recover damages for personal injuries, the plaintiff appeals from a judgment of the Supreme Court, Kings County (Held, J.), dated August 9, 2006, which, upon the granting of the defendant’s motion pursuant to CPLR 4401 for judgment as a matter of law, made at the close of the plaintiffs case, is in favor of the defendant and against her dismissing the complaint.

Ordered that the judgment is reversed, on the law, the motion *658is denied, the complaint is reinstated, and the matter is remitted to the Supreme Court, Kings County, for a new trial, with costs to abide the event.
