This capital appeal, filed pursuant to the Post Conviction Relief Act, 42 Pa.C.S.A. §§ 9541-9546 (“PCRA”), returns following our remand of the case to the Monroe County Court of Common Pleas (“PCRA court”). 1 At issue in this appeal is whether, following remand from an appellate court with specific instructions, a PCRA court may treat new claims raised by the petitioner, which are outside the scope of the remand order, as amending the petitioner’s first, timely PCRA petition.
