The plaintiff-respondent has filed a motion to dismiss defendant’s appeal to this court.

Defendant was charged with driving a motor vehicle while under the influence of intoxicating liquor on March 22, 1953, within the corporate limits of the city of Salem, Oregon, contrary to the provisions of § 31, of ordinance No. 3401, of said city. A jury trial in the municipal court of the city of Salem on May 28, 1953, resulted in a verdict of guilty.
