delivered the opinion of the Commission of Appeals, Section A.

This suit was instituted in the District Court of Dallas County by Mrs. Alecia B. Paschall, the surviving wife of W. E. Paschall, deceased, and by the minor children of said W. E. Paschall. They will be designated as plaintiffs. The action was against the Gulf, Colorado & Santa Fe Railway Company, herein referred to as defendant Railway Company, and Grover S. Campbell, herein designated defendant Campbell.
