Appellee, C. J. Halbrook, plaintiff below, brought this suit against V. C. Wiggins, mayor of the City of Odessa, a municipal corporation, incorporated under the general laws of the state, and against W. M. Marrs, John Perry, Charles Christian, W. F. Matthews, and J. J.
