This is an original proceeding in quo warranto in which the plaintiff seeks to oust the defendant from the office of county attorney of McPherson county, and to be adudged to be entitled to the office himself. The plaintiff and the defendant were opposing candidates for election to the office of county attorney at the. last general election. The plaintiff received about one-twentieth of the votes cast and the defendant nineteen-twentieths.
