MEMORANDUM-DECISION AND ORDER
MUNSON, District Judge.
Presently before the court are defendants’ motions to dismiss the instant action. In addition, defendant Paul Brandt moves for sanctions under Fed.R.Civ.P. 11. The court heard argument on the motions on January 30,1989.
BACKGROUND
This action was commenced on June 23, 1988. Plaintiff, West Mountain Sales, Inc. (“West Mountain”), filed a complaint which listed seven causes of action: six are state law causes of action and one, the third cause of action, alleges a violation of the Racketeering Influenced and Corrupt Organizations Act (“RICO”),…
