Appeal from a judgment of the superior court for Thurs-ton county, Linn, J., entered May 20, 1907, upon findings in favor of the plaintiff, after a trial on the merits before the court without a jury, in an action to declare a contract a mortgage and to foreclose the same.

On the 19th day of July, 1898, David Mitchell and wife, as owners of the property now in controversy, entered into a contract whereby they agreed to convey to the defendants, and the defendants on their part agreed to purchase, to pay the purchase price in certain specified installments with interest, and to pay regularly and seasonably all taxes and assessments levied against the property from and after the day of the contract of sale.
