Bonesteel, one of the defendants in error, who is the wife of the other defendant in error, commenced an action in the circuit court for the county of Fond du Lac against the plaintiff in error, upon a promissory note; and, upon her affidavit, which sufficiently shows that he was about to leave the state for the purpose of residing permanently in the territory of Dacotah, she obtained from the judge of that court at chambers a writ of ne exeat, which required the defendant therein to give bail in the sum of twelve hundred dollars that he would not go, or attempt to go,…
