BACKGROUND
This lawsuit involves a challenge to the City and County of Honolulu’s practice of charging non-residents a $3.00 fee to enter the beach area of Hanauma Bay. Hanauma Bay, a state designated nature preserve, is a beautiful cove located on the south-east side of Oahu popular* amongst both local residents and tourists alike for activities such as swimming, snorkeling, sun bathing and picnicking.
