Appeal by the defendant from a judgment of the County Court, Nassau County (Thorp, J.), rendered September 26, 1985, convicting him of operating a motor vehicle while under the influence of alcohol as a felony and aggravated unlicensed operation of a motor vehicle in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is affirmed.

Contrary to the defendant’s contentions, we conclude that the court properly exercised its discretion in denying his motion for a trial order of dismissal. Upon such a motion, the trial court must view the evidence in the light…
