The plaintiff was the owner of a lot of land on the easterly side of Fifth avenue, in the city of New York. Sarah A. Livermore, the defendant’s grantor, was the owner of a lot adjoining the northerly line of the plaintiff’s lot. The plaintiff being about to erect a building upon his land, entered into an agreement, in writing, with Sarah A.
