Appeal from a judgment of the Superior Court of San Joaquin County, and from an order refusing a new trial. The facts- are- stated in-the-opinion of the- court.

This was an action to determine a contest about the right to purchase a parcel of land as a portion of the one hundred and fifty thousand acres of land granted to the state for the use of an agricultural college.

The right was adjudged in favor of plaintiff. From the judgment and an order denying a motion for a new trial, the defendant appeals.

The application of each of the contestants was made to the land agent of the university under sections 3533 and 3534 of the Political Code. Defendant’s application was first in time. It bears date the 26th of February, 1874; that of the plaintiff about…
