Before the Court is the Defendant’s Motion to Dismiss the Complaint filed by Nadia Youkelsone (the “Plaintiff’). For the reasons set forth below, the Court grants the Defendant’s Motion.
I. FACTUAL BACKGROUND
Defendant Washington Mutual, Inc. (“WMI”), a Washington corporation, was a savings and loan holding company whose primary asset was Washington Mutual Bank (‘WMB”). On September 25, 2008, WMB’s primary regulator, the Office of Thrift Supervision, seized WMB and appointed the Federal Deposit Insurance Corporation (“FDIC”) as receiver.…
