Respondent is the surviving widow of Charles Hepner, deceased, who was killed in November, 1924. Prior to his death he had been working for the Peninsula Railway Company. ‘ While so employed, he became incapacitated for work on account of trouble with his knee, and at the time of his death was struck by a railroad train, death following instantly.

Respondent filed a claim with the department of labor and industries, which was rejected, and appeal was taken to the superior court. The complaint, briefly stated, alleged the following facts:
