On September 28, 1981, plaintiff Village of Fox Lake (the Village) filed an action in the circuit court of Lake County against defendants Aetna Casualty & Surety Co. (Aetna) and Santucci Construction Co. (Santucci) to recover damages allegedly caused by Santucci’s breach of contract for installation of sewer and water lines in the Village and by Aetna’s breach of its performance bond obligations.
