Appellant Nathaniel Abraham (“Dr.Abraham”) appeals the denial of his motion for leave to file an amended complaint, and the district court’s decision not to apply equitable tolling principles in granting a motion for judgment on the pleadings filed by Appellees Woods Hole Oceanographic Institution (“WHOI”) and Mark E. Hahn (“Dr.Hahn”)(collectively “Defendants”). For the reasons set forth below, we find that Dr. Abraham’s appeal lacks merit. Dr. Abraham’s request to amend is futile.
