Heniff Transportation Systems, LLC (“Heniff’) was hired to transport chemicals from Texas to Illinois. It in turn hired Trimac Transportation Services, Inc. (“Trimac”) to clean the tanker prior to the trip. The cleaning was not performed correctly, and the chemicals became contaminated. Heniff sued Trimac for the resulting damages. The district court dismissed Heniff s state law claims, finding that they were preempted by the Carmack Amendment, codified in relevant part at 49 U.S.C. § 14706 et seq., which establishes a federal liability regime for claims…
