I. Background
On March 12, 2001, Plaintiff Dun Shipping Ltd. (“Plaintiff’ or “Dun Shipping”) filed a complaint (“Complaint”) seeking, among other things, to compel Defendants Hovensa L.L.C (“Hovensa”) and Amerada Hess Shipping Corporation (“Hess Shipping”) (collectively, “Defendants”) to arbitrate Plaintiffs maritime claim for contribution to costs (“General Average Claim”) incurred in refloating the vessel M/T Knock Dun (“Knock Dun”).
