This is a trademark infringement action brought under the Lanham Act, 15 U.S.C. §§ 1051 et seq. The plaintiff, Little Caesar Enterprises, Inc., owns two registered trademarks — the words “LITTLE CAESARS” and a drawing of a toga-clad man eating a slice of pizza — used in connection with the operation of what is said to be “America’s largest carry-out pizza chain.” The defendants are the past and present owners and operators of two Italian restaurants in Chattanooga, Tennessee.
