Tliis is an appeal from a decree granting a petition to open a default judgment. The appellant, Edmund Ruczynski, filed a complaint on December 30, 1971, against the appellees, Jesray Construction Corporation and Executive Park Homes. A third defendant in the trial court, Homemart Real Estate, Inc., is not involved in this appeal.

The complaint requested that the appellees be ordered to specifically perform a written contract by conveying to the appellant a home for which the appellant had tendered payment less $4,000.00 already paid. The appellant also…
