Appeal from a judgment of the County Court of Chemung County (Hayden, J.), rendered May 26, 2006, convicting defendant upon his plea of guilty of the crime of attempted promoting prison contraband in the first degree.

Defendant, a prison inmate, was indicted on one count of promoting prison contraband in the first degree. While that charge was pending, a second indictment was handed up against defendant charging him with another count of promoting prison contraband in the first degree.
