The defendant, Richard Larry Hunt, was convicted of murder in the first degree and was sentenced to death. He appeals to this court as of right. B. B. 1:2-1 (c).

The deceased, Helen Elizabeth Hunt, wife of the defendant, was shot to death in New Brunswick on June 20, 1956. The State alleges that the defendant murdered her and that the murder was willful, deliberate and premeditated.
