This is an original petition for a writ of mandamus to compel defendants, members of the board of election commissioners of the city of Chicago, and Edmund K. Jarecki, judge of the county court of Cook county, to destroy the ballots used at certain elections held in the city of Chicago.

Plaintiff’s petition alleges that he is a resident, elector and taxpayer of the city of Chicago; sets out the statute creating the board of election commissioners and alleges that applicable election statutes require that such ballots shall be preserved for six months and thereafter shall be destroyed, except…
