Defendant has appealed from a judgment in favor of the plaintiff in this action, which'was brought to recover *176damages for breach of a covenant contained in a deed of conveyance of real estate.

Defendant contends that the court did not have jurisdiction of the subject matter. The determination of this question Avill be decisive of this appeal.
