INTRODUCTION

The question before us is whether the trial court abused its discretion in denying a motion to certify a class under Proposition 64. Plaintiff Augusto Ticconi sued his health insurance provider defendant Blue Shield of California Life & Health Insurance Company (Blue Shield Life) 1 under the unfair competition law (Bus. & Prof. Code, § 17200 et seq. (the UCL)).
